1. Introduction        

This policy describes the information we collect, how it is used and shared. We recommended you read this carefully, so you understand how your information is shared.

2.  Terms Used in this Policy.  

As used in this Privacy Policy, the term “Websites” are Road Lives’s websites, including all services, content, functionality, features, links, and files contained in or provided by any of Road Lives’s websites.   The term “Applications” are Road Lives’s mobile applications, including all services, content, functionality, features, links, and files contained in or provided by any of Road Lives’s mobile applications. The Websites and Applications are collectively the “Online Services”).  The terms “Road Lives”, “we”, “us” and “our” refer to Road Lives, LLC.  The terms “you” and “your” refer to any “users” of either the Websites or the Applications.  All those subject to this Privacy Policy are referred to as a “user” or “users” for purposes of this policy. The term “Shipper” are those users of the Online Services who request or receive transportation services.  The terms “Driver” or “Drivers” are those users of the Online Services who provide transportation individually or through their independently owned company.  The term “Carriers” are those users who own and operate transportation companies.  The term “Brokers” are those users who are licensed to broker the transportation of freight.  The term “Dealers” are those users who sell, license or lease vehicles, trailers, parts, equipment and other goods for the transportation industry.   The term “Servicers” are users who offer or provide goods or services for or to various persons and entities in the transportation industry.

3. Data Collections and Uses

a. Scope

This Privacy Policy describes how Road Lives and its affiliates collect and use personal information. This policy applies to all users of Road Lives’s Online Services anywhere in the United States. The practices described in this Privacy Policy are subject to applicable laws in the United States. This means that we only engage in the practices described in this policy in the United States.

b. The Information We Collect

The following information is collected by or on behalf of Road Lives:

(1) Information you provide

This may include:

• User profile: We collect information when you create or update your Road Lives account. This may include: your name, email, phone number, login name and password, address, payment or banking information (including related payment verification information), government identification numbers such as Social Security number, driver’s license or passport if required by law, birth date, photo, signature and all other information that you submit to us. This also includes vehicle or insurance information of drivers. Additionally, this includes the preferences and settings that you enable for your Road Lives account.
• Demographic data: We may collect demographic information about you, including through user surveys. We may also receive demographic information about you from third parties. This information may include any preferences you may have.
• User content: We may collect information that you submit when you use or access Road Lives’s Online Services, including any comments or postings, any connections you make while using the Online Services, or when you otherwise contact Road Lives through any of the Online Services.

(2) Information created when you use our services

This may include:

• Location Information: Depending on the Road Lives services that you use, and your settings or device permissions, we may collect your precise or approximate location information as determined through data such as GPS, IP address and Wi-Fi.

• If you are a Driver, Road Lives collects location information when the Road Lives app is running in the foreground (app open and on-screen) or background (app open but not on screen) of your device.
• If you are a Carrier and have provided permission for the processing of location data, Road Lives collects location information on your vehicles when the Road Lives app is running in the foreground. In certain regions, Road Lives also collects this information when the Road Lives app is running in the background of your device if this collection is enabled through your app settings or device permissions.
• Users may use the Online Services without enabling Road Lives to collect their location information. However, this may affect the functionality available on the Online Services. For example, if you do not enable Road Lives to collect your location information, you will have to manually enter your address when needing goods or services that are location specific, or when searching for available loads to transport.

• Transaction information: We may collect transaction details related to your use, sales, purchases, and inquiries of services, loads, or products offered through the Online Services, including the type of such services, loads or products, the amount charged, and payment method.
• Usage information: We may collect information about how you interact with our Online Services. This includes information such as access dates and times, features or pages viewed, crashes and other system activity, type of browser, and third-party sites or services you were using before and after interacting with our Online Services. In some cases, we collect this information through cookies, pixel tags, and similar technologies that create and maintain unique identifiers. This may include cookies and similar data.
• Device information: We may collect information about the devices you use to access our Online Services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.
• Communications data: We may enable users to communicate with each other and with Road Lives through portions of the Online Services. For example, we may enable Drivers/Carriers, Shippers and Brokers to communicate with each other through the Online Services. To provide this service, Road Lives receives some information regarding the communications, including their date and time and the content of the communications. Road Lives may also use this information for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services, and for analytics.

(3) Information from other sources

These may include:

• User feedback, such as ratings or compliments.
• Users providing your information in connection with any goods or services you may offer or provide.
• Users requesting services for or on your behalf.
• Users or others providing information in connection with claims or disputes.
• Road Lives business partners through which you create or access your Road Lives account, such as payment providers.
• Users providing your information in connection with job postings.
• Users postings on you.
• Publicly available sources.
• Marketing service providers.

Road Lives may combine the information collected from these sources with other information in its possession.

c. How We Use Your Information

Road Lives uses the information it collects for various purposes, including:

(1) Providing services and features

Road Lives uses the information we collect to provide, personalize, maintain and improve our products and services. This includes using the information to:

• Create and update your account.
• Verify your identity.
• Enable and develop transportation and other services.
• Facilitate connections between various users of our Online Services.
• Process or facilitate payments.
• Enable features that allow you to share information with other users and people.
• Tailoring offerings of certain products or services.
• Enable and develop features to personalize your Road Lives’s account and experiences using the Online Services, such as creating bookmarks for your favorite places and to enable quick access to previous destinations.
• Perform internal operations necessary to provide our Online Services, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing, and research, and to monitor and analyze usage and activity trends.

(2) Safety and security

We use your data to help maintain the safety, security and integrity of our Online Services and users.

(3) Customer support

Road Lives uses the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services, including to:

• Direct your questions to the appropriate customer support person,
• Investigate and address your concerns, and
• Monitor and improve our customer support responses.

(4) Research and development

We may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the safety and security of our Online Services, develop new features and products, and facilitate connections between users of our Online Services.

(5) Communications among users

Road Lives uses the information we collect to enable communications between our users.

(6) Communications from Road Lives

Road Lives may use the information we collect to communicate with you about products, services, promotions, news, updates and events. Road Lives may also use the information to serve you relevant advertisements and content. You may receive some of these communications based on your profile as a Road Lives user.

(7) Legal proceedings and requirements

We may use the information we collect to investigate or address claims or disputes relating to your use of Road Lives’s services, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.

d. Cookies and Third-Party Technologies

Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. Road Lives uses cookies and similar technologies for purposes such as:

• Authenticating users.
• Remembering user preferences and settings.
• Determining the popularity of content.
• Delivering and measuring the effectiveness of advertising campaigns.
• Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our Online Services.
• We may also allow others to provide audience measurement and analytics services for us, to serve advertisements on our behalf across the internet, and to track and report on the performance of those advertisements. These entities may use cookies and other technologies to identify your device when you visit our Websites or use or access our services, as well as when you visit other online sites and services.

e. Information Sharing and Disclosure

Road Lives may share the information we collect:

(1) With other users

• For example, if you are Driver or Carrier seeking a load, or a Broker offering a load, we may use information we have collected to notify you of the availability of such load.  If you are a Shipper, we may use your information to notify you of available Drivers and Carriers who could potentially ship your freight.  If you are a Driver or Carrier requesting certain goods or services, we may share your information with Brokers, Dealers or Servicers.  

(2) At your request

This includes sharing your information with other people at your request. For example, we may share your location with or your trip information with your family, employer, or business.

(3) With the general public when you submit content to a public forum

We look forward to hearing from our users -- including through public forums such as Road Lives blogs, social media, and certain features on our network. When you communicate through those channels, your communications may be viewable by the public.

(4) With the owner of Road Lives accounts that you may use

If you use a profile associated with another party, we may share your information with the owner of that profile. This occurs, for example, if you are a Driver using an account owned by a transportation company.

(5) With Road Lives affiliates

We share information with our affiliates to help us provide our services or conduct data processing on our behalf.

(6) With Road Lives service providers and business partners

Road Lives may provide information to its vendors, consultants, marketing partners, research firms, and other service providers or business partners. This may include, for example:

• Payment processors and facilitators.
• Cloud storage providers.
• Marketing partners and marketing platform providers.
• Data analytics providers.
• Research partners, including those performing surveys or research projects in partnership with Road Lives or on Road Lives’s behalf.
• Vendors that assist Road Lives to enhance the safety and security of its apps.
• Consultants, lawyers, accountants and other professional service providers.

(7) For legal reasons or in the event of a dispute

Road Lives may share your information if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.

This includes sharing your information with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms and Conditions or other policies, to protect Road Lives’s rights or property or the rights, safety or property of others, or in the event of a claim or dispute relating to your use of our services.

This also includes sharing your information with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

(8) With your consent

Road Lives may share your information other than as described in this Privacy Policy if we notify you and you consent to the sharing.

f. Information Retention

Road Lives requires user profile information in order to provide its services and retains such information for as long you maintain your Road Lives account.  Further, Road Lives may also retain certain information if necessary, for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Road Lives shuts down a user's account because of unsafe behavior or security incidents, Road Lives may retain certain information about that account to prevent that user from opening a new Road Lives account in the future.

g. Deletion of Account

If you choose to delete your account. All user data including but not limited to content you posted to social media, messages sent and received, business accounts you created and any listings (i.e. Breakdown Directory, Marketplace, Job Board, Digital Ads) will be deleted. You have the option to deleted a Business Account only in which all content entered for the Business Account will be deleted, but your personal account will remain active and not effected allowing you to still use the service as a basic User account.

4. Choice and Transparency

a. Privacy Settings

The Privacy Settings menus on the Websites and in the Applications gives users the ability to set or update their location and contacts sharing preferences, and their preferences for receiving mobile notifications from Road Lives. Information on these settings, how to set or change these settings, and the effect of turning off these settings are described below.

• Location Information

• Location data helps improve our services.
• You may enable/disable, or adjust, Road Lives’s collection of your location information at any time through the Privacy Settings menu or via the settings on your mobile device. If you disable the device location services on your device, your use of the Road Lives app will be affected.
• If you have enabled the device location services on your mobile device, you may also enable Road Lives to share your location with other users in order to provide certain services to you.

• Notifications

• You may enable Road Lives to send you push notifications about promotions, offers, alerts, discounts and news from Road Lives and its business partners. You may enable/disable these notifications at any time through the Privacy Settings menu.

b. Device Permissions

Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without your consent. And these platforms have different permission systems for obtaining your consent. The iOS platform will alert you the first time the Road Lives Application wants permission to access certain types of data and will let you consent (or not consent) to that request. Android devices will notify you of the permissions that the Road Lives Application seeks before you first use the app, and your use of the Application constitutes your consent.

c. Explanations, Copies and Correction

You may request that Road Lives:

• Provide a detailed explanation regarding the information Road Lives has collected about you and how it uses that information.
• Receive a copy of the information Road Lives has collected about you.
• Request correction of any inaccurate information that Road Lives has about you.

You can make these requests by contacting Road Lives.

You can also edit the name, phone number and email address associated with your account through the Settings menu.

d. Marketing Opt-Outs

You may opt out of receiving promotional emails from Road Lives. You may also opt out of receiving emails and other messages from Road Lives by following the instructions in those messages. Please note that if you opt out, we may still send you non-promotional messages when deemed necessary by Road Lives.
